The fourth National Legal Aid Conference themed on climate change and environmental justice, aimed to address the pressing issue of the climate crisis from a global perspective.  The focus will be on fostering dialogue around the opportunities, gaps, and solutions necessary to enhance responses, adaptation, and mitigation efforts to the climate crisis. The conference's primary goal is to promote environmental justice, particularly for disadvantaged and marginalized communities, including the poor, vulnerable populations, Indigenous Peoples, and local communities. These discussions will aim to generate actionable strategies for improving access to environmental justice for people that are disproportionately affected by climate change.

Through a peer-to-peer approach, the conference aims to: 

  • Explore strategies and recommendations to enhance access to environmental justice for the vulnerable and marginalized groups. 
  • Seek participants’/stakeholders’ input on the strategies and recommendations for enhancing access to environmental justice and legal aid for vulnerable and marginalized groups. 
  • Showcase use of innovative approaches for provision of legal aid for environmental justice to vulnerable and marginalized group

Expected Outputs 

  • Documented best practices in mitigating climate change crises in a global context 
  • Heightened stakeholders’ engagements, networking, and collaboration for building  synergies for access to justice in climate change and environmental 
  • Enhanced understanding and appropriate use of science technology and technology in the context of climate change and environmental justice 
  • Better strategies for monitoring climate change crises to ensure access to justice,

  • Legal experts from across the continent and beyond including academia, civil society experts, media representatives, regional and international organisations.
  • Government representatives from various countries specifically from the Ministries responsible for environment, state corporations and government agencies, Climate Change and environmental bodies, judges from environment and land court, prosecutors, law associations and other organisations of legal professionals. 
  • Representatives the global sub regions in Africa, Asia, Americas and Europe

The environment plays a critical role in human rights, such as access to a dignified life, health, housing, food, and water. However, overexploitation of natural resources, pollution, and climate change threaten these rights, exacerbating poverty and inequalities, especially for vulnerable communities. Climate change increases the frequency of natural disasters and worsens food and water insecurity, disproportionately affecting women, girls, and marginalized groups. Although international efforts like the UNFCCC and COP27 have made progress, including the establishment of a loss and damage fund, more decisive action is needed.

The COVID-19 pandemic exposed deeper inequalities, highlighting the urgency of addressing environmental injustices. Climate change impacts not only fundamental human rights but also poses significant challenges to sustainable development and economic stability. Efforts like the Human Rights Council's resolution on the right to a healthy environment stress the importance of environmental protection for human rights. As climate change continues to affect the planet, justice systems must evolve to address these challenges, focusing on distributive and procedural justice, as well as empowering marginalized voices. Despite global recognition of these issues, the world still struggles with the equitable implementation of climate policies and the protection of human rights.

The outcomes of the conference will serve as the foundation for developing a handbook on legal aid and environmental justice, tailored to the Kenyan context. This handbook will outline recommendations, strategies, and innovative ideas for practical implementation, with the hope that the strategies developed can inspire similar initiatives in other countries
