One of the key obstacles for many countries, particularly at municipal level, is to procure the services from Energy Service Companies (ESCO) in pursuit of improved energy efficiency of existing installations. Typical contractual arrangements with ESCOs are based on ‘Energy Performance Contracting’, which in many jurisdictions is seen as something of a hybrid between a services contract and a goods supply contract. In many jurisdictions, it is challenging to adopt this duality in contract interpretation, which ultimately ends up standing in the way for municipal (or central government) investment in improved energy efficiency.This event presents UNOPS as a possible mediator of this challenge by applying UNOPS procurement procedures to the engagement with ESCO. In most cases, UNOPS procurement rules are observed in addition to national procurement regulation, but may also be standing in in situations, where national procurement rules are insufficient to ensure a smooth procurement process. The event will explore how Energy Performance Contracting can benefit from the clarity that UNOPS procurement rules provide.
